This policy applies across Tolchards Limited, including our trade business, Tolchards Drinks mobile application and online ordering services, and The Wine Box retail operation. It is intended for customers, prospective customers, website and app users, suppliers, business contacts, visitors and other people who interact with us.

Tolchards Limited ("Tolchards", "we", "us" or "our") is committed to protecting your personal information and respecting your privacy. This Privacy Policy explains how we collect, use, store and share personal information when you interact with us, including when you:

visitor-book records such as name, organisation, person being visited, arrival time and departure time.
When you pay by card through our online ordering services, full card information is entered directly into the relevant payment processor. For Tolchards Drinks, card payments are processed by Stripe. We do not routinely store your full payment-card number or security code.
Direct Debits may be processed through Barclays, and relevant bank details are also held within our Vintner business system. The Wine Box uses Shopify Payments for online payment processing.
Passwords used for Tolchards Drinks and our online services are handled through our authentication systems. We do not require customers to provide their password to Tolchards staff.
4. Where we obtain your information
We obtain most personal information directly from you or from the business you represent. We may also receive information from:
other authorised users of your business account;
trade references supplied by you;
Creditsafe;
payment and banking providers;
delivery and logistics providers;
suppliers and manufacturers;
professional advisers;
public authorities;
our technology providers; and
other organisations where there is a lawful reason for them to provide the information.
For example, where you provide trade references as part of a credit application, we may contact those organisations and obtain information concerning your trading or payment history.
5. How and why we use your information
We process personal information where there is a lawful basis to do so. Depending on the circumstances, we rely on one or more of the following:
Contract: where processing is necessary to enter into or perform a contract with you.
Legitimate interests: where processing is necessary for our legitimate business interests, provided those interests are not overridden by your rights and interests. These interests include operating our business, managing customer relationships, fulfilling orders, improving our services, securing our systems, preventing fraud, managing credit risk and promoting our products and services.
Legal obligation: where we need to process information to comply with the law, taxation requirements, regulatory requirements or other legal obligations.
Consent: where we have specifically asked you to consent, such as certain forms of electronic marketing or device permissions. Consent may be withdrawn where applicable.

6. Trade account and credit applications
Prospective customers may apply for a Tolchards trade account through our website, app or other application methods. Submitting an application does not automatically create or approve an account. Applications are reviewed by our Credit Control team.
Our assessment may include:
reviewing the information you provide;
checking whether we can service your location;
contacting trade references;
undertaking a Creditsafe credit check; and
considering other relevant commercial and credit information.
Information from Creditsafe or trade references may be recorded or retained as part of our assessment.
Credit decisions are made by a person within Tolchards Credit Control. We do not rely on solely automated decision-making to approve or decline a trade account.
7. Tolchards Drinks mobile application and online ordering
The Tolchards Drinks application is operated by Tolchards Limited. Anyone may download the application, but a Tolchards account is required to access customer-specific functionality and place orders. Prospective customers may submit an account application through our online services. Applications are reviewed before a trading account is opened.
Information processed through Tolchards Drinks
Depending on the features you use, the app may process:
your email address;
login and authentication information;
account permissions;
customer account information;
customer-specific pricing;
account balances;
invoices and statements;
order and purchase history;
saved baskets and lists;
products viewed or searched for;
delivery information;
delivery/order notes;
live-chat messages;
uploaded files and documents;
images you choose to upload;
voice input;
technical/device information; and
information associated with push notifications.
One login may be authorised to access multiple Tolchards customer accounts. Customer account owners and administrators can invite other people to access an account. An invitation requires the person's email address. Account owners can manage administrators and users, while authorised administrators can manage standard users. Customers are responsible for ensuring access is only given to appropriate people and for removing users who should no longer have access.
Device permissions
Camera and photos: for barcode/product scanning, uploading images and attaching images to live chat.
Microphone: for voice dictation and voice-assisted order or product entry.
Files and documents: so that you can upload files such as Excel or PDF order sheets or attach documents to live chat.
Notifications: so that Tolchards can send order updates, delivery information, service announcements, account messages and, where appropriate, promotional messages.
The app does not require your mobile device's GPS location to provide these services. Permissions are requested in connection with the relevant functionality and can generally be managed through your device settings.
Payments and transactional messages
Card payments initiated within Tolchards Drinks are handed off to Stripe for processing. Tolchards does not routinely receive or store the full card number or security code entered into Stripe.
Order confirmations, password/account messages and other transactional email generated through the Ordertools platform may be delivered using Amazon Simple Email Service (Amazon SES).
Live chat
The app and website include live-chat functionality provided as part of the Ordertools platform. Information you type into live chat, together with any attachments you choose to provide, will be processed so that we can respond to your enquiry and maintain an appropriate record of the conversation.
8. Artificial intelligence and automated assistance
Our online ordering systems may use artificial-intelligence technology to assist customers and our staff. This may include:
AI-assisted product search;
interpreting product or order requests;
assisting with voice input;
interpreting uploaded order files;
transcribing voicemail;
extracting order information; and
generating an order draft for review.
Ordertools may use third-party AI technology providers, which may include Anthropic and OpenAI, as part of providing these capabilities. Information submitted to an AI-enabled feature may therefore be processed by the technology required to provide that feature.
We do not describe these services as making significant decisions about customers without human involvement. For example, where AI interprets a customer voicemail and creates a proposed order, that order is reviewed by Tolchards staff. AI functionality is not used to make automated credit-account approval decisions.
Users should avoid including unnecessary sensitive personal information in order notes, uploaded documents, live chat or other free-text fields.
9. Voicemail ordering
Customers may leave voicemail messages containing orders or other requests. Voicemails may be stored within RingCentral, within Tolchards voicemail systems or queues, within emails delivered to relevant Tolchards staff, and within Ordertools where the voicemail relates to an order.
Voicemails submitted to Ordertools may be processed using AI to:
transcribe the recording;
identify products and quantities;
create a proposed order or order draft; and
allow a Tolchards employee to review the proposed order.
Where a voicemail forms part of the evidence of how an order was placed, the original recording may be retained alongside the associated order record.
10. Telephone calls
Telephone calls to or from Tolchards may be recorded. Callers are informed where call recording is in operation. Recordings may be used for customer service, training and quality monitoring, verifying customer instructions or orders, resolving complaints or disputes, protecting Tolchards and its customers, and investigating incidents or legal matters.
Our telephone service is provided using RingCentral. Normal telephone call recordings are ordinarily retained for approximately 90 days, unless a recording is required for longer in connection with a complaint, investigation, dispute or legal matter. Voicemails may be retained separately as described above.
11. Telesales and customer contact
Telephone ordering is an important part of Tolchards' service. Many customers have an agreed or regular call day on which our Telesales team contacts them to take their order. During these calls we may also discuss relevant offers, new products, promotions and other products or services which may be of interest.
Customers can ask us not to use telephone calls for promotional purposes while still receiving necessary communications relating to orders, deliveries and their account.
12. Marketing
We may contact customers and prospective customers about Tolchards products, services, promotions and events where permitted by law. Channels may include email, telephone, occasional postal marketing, push notifications and relevant communications through our sales team.
Tolchards uses Mailchimp for certain customer communications, updates, offers and marketing. Marketing emails include a method of unsubscribing.
SMS messages used by Tolchards are currently primarily operational messages, including delivery ETAs, successful delivery notifications and unsuccessful delivery notifications.
We may use purchasing information to segment customers so that communications, offers and product information are more relevant. For example, this may involve identifying customers who purchase particular categories of products.
Where consent is required for marketing by law, we will seek appropriate consent. You have the right to object to direct marketing at any time. You may unsubscribe using the link in an email, tell our staff during a telephone call, or contact us at privacy@tolchards.com.
Stopping marketing does not stop us contacting you about your account, orders, payments, deliveries, product recalls or other necessary service matters.
13. Deliveries, vehicle tracking and proof of delivery
Tolchards uses delivery and route-management technologies including MaxOptra and Samsara. Our delivery vehicles may be tracked using GPS for route planning, fleet management, operational management, delivery planning, calculating delivery ETAs, safety, security and investigation of incidents.
Customers may receive an estimated arrival time derived from vehicle location information. Customers are not provided with the vehicle's live GPS location.
MaxOptra is also used for electronic proof of delivery (EPOD). EPOD information may contain the name of the recipient, a signature, delivery date/time information, delivery notes and potentially a photograph of the delivery. We use this information to confirm delivery, respond to queries and resolve disputes.
14. Delivery and service partners
Where appropriate, we may provide necessary information to third-party delivery companies, hauliers, couriers or contractors. This may include customer/site name, delivery address, recipient/contact information, delivery instructions and relevant order information. Information is provided only as reasonably necessary to perform the relevant delivery or service.
15. Equipment, installations and customer-site services
Tolchards may provide, install, loan, service or maintain equipment at customer premises. This may include dispense equipment, coolers, furniture or other equipment/support.
We may maintain records concerning customer premises, contact details, equipment supplied, equipment serial numbers, installation location, service history, surveys, photographs, measurements, maintenance activity, contractual arrangements and equipment loans.
Some records are maintained in Microsoft 365, including Excel files stored through OneDrive or SharePoint. Services may be carried out by Tolchards staff or third-party contractors. Where necessary, customer information may be provided to contractors, equipment manufacturers, warranty providers, technical-support providers and service companies.
16. Ullages, returns, credits and product issues
If a customer receives stock that is damaged, faulty, flat, partly empty or otherwise unsuitable for resale, we may process an ullage claim or other credit request. Information may include customer details, product information, quantities, batch or identifying information where relevant, reason for the claim, photographs or other evidence, order/invoice details and correspondence concerning the claim.
We may provide relevant information to the applicable brewery, manufacturer, supplier or brand owner so that a credit can be requested or administered. We also retain information relating to returns, breakages, refunds, complaints, product-quality issues and related credits.
17. Product recalls
We may use purchasing and order history to identify customers who have received a product affected by a recall or safety issue. We may contact those customers and, where necessary, exchange relevant information with suppliers, manufacturers, brand owners and public or regulatory authorities.
18. CCTV and vehicle cameras
We operate CCTV at Tolchards premises and The Wine Box. CCTV is used for protecting employees, customers and visitors; protecting property and stock; health and safety; preventing and detecting crime; investigating incidents; managing security; and establishing, exercising or defending legal claims. CCTV signage is displayed at our sites.
We aim to retain fixed-site CCTV footage for approximately 30 days. Footage may be retained for longer where required in connection with an incident, investigation, complaint, legal claim or law-enforcement request.
Tolchards delivery vehicles are fitted with forward-facing road cameras and driver/cab cameras. Vehicle-camera footage may therefore capture individuals, vehicles, customer premises or members of the public. Vehicle-camera footage is generally available for up to approximately 120 hours, although relevant footage may be preserved for longer where required for an incident, investigation or legal purpose.
19. The Wine Box
The Wine Box is a retail operation of Tolchards Limited and is covered by this Privacy Policy. The Wine Box processes information relating to physical retail sales, online purchases, customer accounts, click & collect, local delivery, nationwide deliveries, events and tastings, marketing, customer enquiries, gift cards, payments and customer service.
Shopify
The Wine Box uses Shopify, including Shopify's ecommerce platform and Shopify POS. Depending upon how a customer interacts with The Wine Box, Shopify may process information including name, email address, telephone number, billing address, delivery address, account information, orders and purchase history, collection information, payment information and relevant technical information.
Online payments are processed using Shopify Payments. The Wine Box customer accounts allow customers to access information such as their order history and details.
Delivery
The Wine Box provides local delivery and may also use carriers including DPD and Royal Mail. The necessary recipient and delivery information will be provided to the applicable carrier.
Age verification
Alcohol purchases are restricted to people aged 18 or over. Customers may be asked to show appropriate identification in-store or when receiving a delivery. Identification is ordinarily inspected to establish age and handed back. We do not routinely copy, photograph or record information from identification shown purely for age verification.
Wine Box marketing
Customers may choose to opt in to The Wine Box marketing. Shopify may be used to send marketing communications and abandoned-cart/recovery messages. The Wine Box may also advertise through social-media and advertising platforms. Its website may use technologies provided by Google and Meta/Facebook for advertising, audience measurement and remarketing, depending upon the campaigns being operated. These non-essential technologies are subject to applicable cookie/consent requirements.
20. Events, tastings and photography
Tolchards and The Wine Box may organise events and tastings. We may process attendee names, email addresses, telephone numbers, booking details, payment information where applicable and communications about an event.
The Wine Box may use Shopify, Outlook and Evey Events for event administration. Tolchards trade events are generally administered using Microsoft Outlook and related Microsoft services.
Photographs or video may be taken at some events for promotional purposes. Where appropriate, attendees will be informed that photography or filming is taking place.
21. Social media and messaging
The Wine Box may interact directly with customers through social-media platforms. Tolchards sales representatives may also communicate with customers using WhatsApp, including WhatsApp Business, as well as email, telephone and SMS. Customers may place orders or make enquiries through those channels.
Information received through those channels may be transferred into Tolchards' systems where necessary to process an order, respond to an enquiry or maintain an appropriate record of the interaction.
22. Analytics and business intelligence
Tolchards uses data to understand and improve its business. This includes Microsoft Power BI for internal reporting and analysis. Analysis may include customer purchasing patterns, product performance, sales trends, customer activity, commercial performance and profitability.
We may also use customer purchasing information to identify relevant product opportunities or customer segments. The Wine Box uses Shopify Analytics. The Tolchards website also uses technologies described in our Cookie Policy, which currently include services relating to authentication, search, performance and technical monitoring.

24. Suppliers, breweries and brand owners
Tolchards works closely with suppliers, breweries, drinks manufacturers and brand owners. Where appropriate, we may share customer/business name, customer site/address, contact names, contact information, products purchased, quantities, order history and sales values.
This may be used for legitimate purposes including account support, sales activity, promotions, rebates, supplier-funded activity, provision of samples, provision of promotional or point-of-sale material, product support, product recalls and ullage/credit claims. We do not necessarily provide all of this information in every case. The information provided depends upon the purpose concerned.
25. Stocktaking services
Where a customer uses an external stocktaking service, relevant information may be provided to the stocktaking company to help provide that service. This may include information about the customer, products, purchases, quantities and sales or supply history.
26. International transfers
Tolchards generally seeks to use providers and hosting arrangements operating within the UK or EEA where reasonably available. However, some of the technology and service providers we use are international organisations. Personal information may therefore sometimes be accessed, supported or processed in countries outside the United Kingdom.
Where personal information is transferred internationally, we take reasonable steps to ensure that an appropriate legal mechanism and safeguards are in place as required by UK data-protection law. These may include UK adequacy regulations or approved contractual safeguards and related protections.

27. Security
We take appropriate technical and organisational measures designed to protect personal information against unauthorised access, accidental loss, misuse, alteration, inappropriate disclosure and destruction.
Measures may include access controls, authentication, encryption, system security controls, device management, backups, staff controls and security monitoring as appropriate to the system concerned.
Tolchards holds Cyber Essentials certification. No information system or method of transmission can be guaranteed to be completely secure, but we regularly review our security arrangements in light of the systems and risks involved.
28. Data retention
We keep personal information only for as long as reasonably necessary for the purpose for which it was collected and to meet applicable legal, tax, accounting, contractual and regulatory requirements.
Where we do not have a specific fixed retention period, we consider factors including the purpose for which the information is held, whether the customer relationship remains active, legal and accounting obligations, the likelihood of complaints or disputes, contractual requirements, potential legal claims, fraud and security requirements, and whether the information can be safely deleted or anonymised.

29. Closing an account and deleting personal information
Closing a Tolchards trading account or Tolchards Drinks login does not necessarily mean that all information concerning the customer can immediately be erased. For example, we may still need to retain orders, invoices, credit notes, payment information, accounting records, contracts, delivery records, fraud/security information and records required to establish or defend legal claims.
Where information is no longer required and there is no lawful reason for continued retention, we will delete or anonymise it as appropriate.
Tolchards Drinks account deletion
Users may request deletion of their Tolchards Drinks account and associated personal information by contacting privacy@tolchards.com. We will review the request and delete the online account information that we are able and required to delete, subject to any information which must legitimately be retained for legal, regulatory, security, fraud-prevention, accounting or contractual reasons.
30. Your data-protection rights
Right of access
You can ask whether we process your personal information and request a copy of information we hold about you.
Right to rectification
You can ask us to correct inaccurate information or complete incomplete information. Customers can also contact our Credit Control team to update their trading-account contact information.
Right to erasure
You may ask us to delete your personal information in certain circumstances. This right is not absolute. For example, information may need to be retained to comply with legal requirements or establish or defend legal claims.
Right to restriction
You may be able to ask us to restrict how we use your information in certain circumstances.
Right to object
You may object to certain processing based on our legitimate interests. You have an absolute right to object to the use of your personal information for direct marketing.
Right to data portability
In certain circumstances you may have the right to receive information you provided to us in a structured, commonly used and machine-readable format or ask us to transfer it to another organisation.
Right to withdraw consent
Where processing is based upon your consent, you can withdraw that consent at any time. Withdrawal does not affect processing which took place lawfully before consent was withdrawn.
Rights concerning automated decision-making
You have rights in relation to certain decisions made solely through automated processing which have legal or similarly significant effects. As described above, Tolchards' trade-account credit decisions are made by a person rather than solely by an automated system.
To exercise a privacy right, contact privacy@tolchards.com. We may need to request appropriate information to confirm your identity before fulfilling a request.
31. Complaints
If you are concerned about how Tolchards has used your personal information, please contact us first so that we have an opportunity to investigate: privacy@tolchards.com.
You also have the right to complain to the UK's data-protection regulator, the Information Commissioner's Office (ICO), at www.ico.org.uk. You do not need to contact Tolchards before exercising your right to complain to the ICO.
32. Cookies
Our websites use cookies and similar technologies for purposes such as providing essential site functionality, authentication, remembering preferences, operating shopping and account features, measuring performance, analytics and marketing/advertising where applicable.
The technologies used differ between the main Tolchards website and The Wine Box. The Tolchards website's Cookie Policy can be found at www.tolchards.com/cookie-policy.
Where required, non-essential cookies and similar technologies will only be used in accordance with the user's cookie/consent choices.
